This ‘DYO’ – Design Your Own web based apparel design facility is hosted and operated by Indico Pty Ltd (Blackchrome). By accessing the Design Your Own and Kit Creator website (dyosub.com, dyo.blackchrome.com.au & kitcreator.blackchrome.com.au) and using our template designs (“DYO Designs”, “Kit Creator Designs”), you agree that:

1. the DYO/Kit Creator is only for use by retail customers and authorised distributors who intend to place orders with Indico Pty Ltd (Blackchrome) for products they design using the DYO/Kit Creator;
2. you are either a retail consumer or an authorised distributor;
3. we retain ownership of all intellectual property (including copyright) vesting in the DYO/Kit Creator designs and in any designs created by you using the DYO/Kit Creator (“Your DYO Design”);
4. you may not use the DYO Designs/Kit Creator Designs or Your DYO Design/Kit Creator Design for any purposes other than to place orders with us; and
5. third party manufacture of products using Your DYO Design/Kit Creator Design or any part of the DYO/Kit Creator Designs is a breach of our rights.
6. we can send you email newsletters and updates.

We reserve the right to restrict access by any user we suspect of using the DYO/Kit Creator for other purposes. We intend:

(a) to take all necessary steps to protect the designs; and

(b) to implement image protection technologies on the designs so we can trace unauthorised use.
